Microsoft distributes Microsoft SQL Server 2005, Microsoft SQL Server 2008, or Microsoft SQL Server 2008 R2 fixes as one downloadable file. Because the fixes are cumulative, each new release contains all the hotfixes and all the security fixes that were included with the previous Microsoft SQL Server 2005, Microsoft SQL Server 2008, or Microsoft SQL Server 2008 R2 fix release.
Symptoms
In Microsoft SQL Server 2005, Microsoft SQL Server 2008, or Microsoft SQL Server 2008 R2, you have a query that contains a large IN clause. For example, the IN clause contains thousands of values. When you run this query, a non-yielding scheduler error may occur. Additionally, a mini-dump file is generated in the SQL Server 2005, SQL Server 2008, or SQL Server 2008 R2 log folder. Sometimes you may also see the following error message in the SQL Server Error log file:
Error: 8623, Severity: 16, State: 1.
The query processor ran out of internal resources and could not produce a query plan. This is a rare event and only expected for extremely complex queries or queries that reference a very large number of tables or partitions. Please simplify the query. If you believe you have received this message in error, contact Customer Support Services for more information.
Note If Error 8623 occurs together with the non-yielding scheduler error, the execution of the query fails.
Cause
This problem occurs because of an issue in the SQL Server code base. During the execution of the query that contains the large IN clause, the SQL Server code base does not yield a scheduler appropriately. This behavior causes CPU starvation for other worker threads that run on the same scheduler and causes a non-yielding scheduler error.

Input the values in the IN clause into a temporary table or a table variable, and then query the result set that joins the original table and the temporary table (or table variable).
Prerequisites
You must have SQL Server 2005 Service Pack 3 (SP3), SQL Server 2008, or SQL Server 2008 R2 installed to apply this hotfix.
Restart requirement
You must restart the computer after you apply this hotfix if one of the SQL Server services is running when you apply this hotfix. If you do not want to restart the computer, stop all the SQL Server services before you apply this hotfix.
Hotfix replacement information

You should be ale to catch the query using a trace. Below is a trace I created and tested with a query generating that error…

Besides that, there are many reasons for causing Error 8623, here is some example:
- Maybe it is caused by compatibility levels, here you can refer to this article
- Explicitly including an extremely large number of values within the parentheses, in an IN clause can consume resources. To
work around this problem, store the items in the IN list in a table, and use a SELECT subquery within an IN clause. - Heavy, complex query or a large number of tables used as a query reference, please refer to SQL Error 8623: What To Do To Handle It And Get Going Again

I recall a query with many CTEs, in which each subsequent CTE references previous CTE’s several times. at some point, a query plan could not be produced. I want to say the largest execution plan I have seen is on the order 100MB?

2008 does indeed have xEvent (XE), but things were renamed between 2008R2 and 2012. So chances are that the trace suggestions we posted won’t work, because things don’t have the same names (events, target, columns, etc).
Also, prior to 2012, there were no GUI for XE and even with a newer SSMS, the XE GUI won’t operate on 2008 and 2008R2 (because of said renaming of things).
I suggest you use the old trace functionality. Use Profiler to configure the trace, I believe that the name of the event is User Error Message. Make sure you have appropriate filtering. Also, consider scripting the trace definition and run it as a «server
Side Trace» to reduce overhead (if you are concerned with that).

We are getting multiple 8623 Errors in SQL Log while running Vendor’s software.
How can you catch which Query causes the error?
I tried to catch it using SQL Profiler Trace but it doesn’t show which Query/Sp is the one causing an error.
I also tried to use Extended Event session to catch it, but it doesn’t create any output either.

I would use Trace (because I’m much more up to speed with it than X-Events) and trace RPC:Starting, Batch:Starting and Error:Exception and Error:Usermessage. I would run it server-side and the analyse after some time, as the net is fairly wide. Of course,
it helps if you know how to reproduce the error from the application.Did you open a case with the vendor?

According to your error message, about which query statement may fail with error message 8623, as other post, you can use trace flag 4102 & 4118 for overcoming this error. Another way is looking for queries with very long IN lists, a large number of
UNIONs, or a large number of nested sub-queries. These are the most common causes of this particular error message.The error 8623 occurs when attempting to select records through a query with a large number of entries in the «IN» clause (> 10,000). For avoiding this error, I suggest that you could apply the latest Cumulative Updates media for SQL Server 2012 Service
Pack 1, then simplify the query. You may try divide and conquer approach to get part of the query working (as temp table) and then add extra joins / conditions. Or You could try to run the query using the hint option (force order), option (hash join), option

The query processor ran out of internal resources and could not produce a query plan. This is a rare event and only expected for extremely complex queries or queries that reference a very large number of tables or partitions. Please simplify the query. If you believe you have received this message in error, contact Customer Support Services for more information.
There are many potential causes for this, and the text of this particular error is very well-written because the primary cause is exactly what is listed — a complex query.
My go-to tool for this and other similar situations is our old friend Extended Events.
One of the keys with Extended Events is to only trap the needed information — only the relevant events, and only the relevant fields for those particular events.
This will collect the relevant info but *only* about error 8623’s. Because there is no path built into the event_file target, it will by default write to the SQL Server error log path. As you can see we are also not collecting a lot of different data fields — just the minimum we need to run down the culprit and where it may be coming from.
My preferred method to access data like this is to query the event file via TSQL — a query for this particular file would look like this:
Hopefully you will find this useful, and this is truly meaningful for any error you are trying to run down — simply change the filter in the XEvents session definition from 8623 to whatever error you are looking for (and probably change the name of the event_file), and voila — you now have a session to run down the source queries for that new error, without any changes to the data return query.
At this point you may wonder what a «complex» query looks like — here is one sample I have found recently:

I have a very long query which uses distinct intersect, when the query grows too long and I execute it it throws above exception

Can you please help me with an alternative to this query?

So essentially what you want is to get RTypeIds’ that are common to all the users?
You could build the same query in this way:
with userrt (rid, uid)
as (select distinct rtypeid, userid from User_Res where UserId in (1749, 424, 1906 ...)
select rid, count(uid) as cuid
from userrt
group by rid
Now only those result rows that have cuid == amount of userid’s in limiting clause are the ones you’re interested in (since they’ve been there for all users and are therefore common to all).
